Termination / restriction of access
drmushme.ie reserves the right, in its sole discretion, to terminate your access to the drmushme.ie website and associated services or any portion thereof at any time, without notice.
General
To the maximum extent permitted by law, this agreement is governed by the laws of Ireland and you hereby consent to the exclusive jurisdiction and venue of the courts in all disputes arising out of or relating to the use of the drmushme.ie web site.
Use of the drmushme.ie website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and drmushme.ie as a result of this agreement or use of the drmushme.ie website. The performance of this agreement by drmushme.ie is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of drmushme.ie’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the drmushme.ie web site or information provided to or gathered by drmushme.ie with respect to such use.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision shall be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and drmushme.ie with respect to the drmushme.ie website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and drmushme.ie with respect to the drmushme.ie website.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and under the same conditions as other business documents and records originally generated and maintained in printed form.
It is the express wish of the parties that this Agreement and all related documents be drawn up in English.

DR MUSH ME RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO DENY FURTHER OR CONTINUED ACCESS TO OUR SITE TO ANY VISITOR, INCLUDING, BUT NOT LIMITED TO, ANY USER WHO HAS VIOLATED ANY ASPECT OF THE TERMS AND CONDITIONS.
Any reference to “Dr. Mush Me” means Dr. Mush Me, its staff, employees, contractors, agents and representatives. Users of Dr. Mush Me are required, as a condition of continued use of the site, to comply with the rules set out below.
These terms and conditions contain very important information regarding our affiliate program and your use of this platform. You agree to be bound by the terms and conditions contained herein when you join our affiliate programme. If you do not agree to the terms and conditions, you are not permitted to use our website or services, and you may not purchase our products.
Eligibility
To become an affiliate, you expressly warrant that you are at least eighteen (18) years old and that the use of our products or services is legal in your place of residence or intended destination. It is your sole responsibility to ensure that this requirement is met. We will not be liable to you for any breach of the provision of this Agreement or any violation of applicable laws in your jurisdiction as a result of your use of the Service.
Obligations of affiliates
You understand that there are certain rules that you must follow at all times to remain in our affiliate program. At our sole discretion, we may cancel your application if we determine that your site is not suitable for our program. We may also cancel your application if you violate any of the terms contained herein. You understand that you must be human. Accounts registered by “bots” or other automated methods are not allowed. We may also cancel your application if:
Promotes sexually explicit content
Promotes violence
Promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age
promotes illegal activities
incorporates material that infringes or assists others to infringe copyright, trademark or other intellectual property rights or to violate the law
Is in any other way unlawful, harmful, threatening, libelous, defamatory, obscene, harassing, or racially, ethnically or otherwise objectionable in our sole discretion
Contains software downloads that potentially misappropriate the commissions of other affiliates of our program.
You may not create a site or platform that you operate, explicitly or implicitly, in a manner that competes with, resembles, or represents the Dr Mush Me site, nor may you design your site in a manner that leads customers to believe that you are Dr Mush Me or any other affiliated business. We strictly disapprove of such activities as we believe it is a misrepresentation of our platform.
As a member of the Dr Mush Me affiliate program, you will have an affiliate dashboard where you can acquire an affiliate URL for our various products.
In our sole discretion, we may, at any time, review your placement and approve the use of your links and codes, and require you to change the placement or use to comply with the guidelines provided to you. You understand that maintaining and updating your site will be your responsibility. We may monitor your site as we deem necessary to ensure that it is up to date and to inform you of any changes that we believe will improve your performance.
It is your sole responsibility to comply with all intellectual property and other laws applicable to your site. You must have express permission to use any person’s copyrighted material, whether written, pictorial or otherwise copyrighted.
We will not be liable to you (and you alone will be liable) for your use of another person’s copyrighted material or other intellectual property in violation of the law or the rights of any third party.
Advertising
You may not use any third party pay-per-click platform or any other kind of advertising on Dr Mush Me related keywords, including but not limited to the Dr Mush Me brand name, product names or terms on Paid per Media on Google Adwords.
The rights and obligations of Dr. Mush Me
We have the right to monitor your site at any time to determine your compliance with the terms and conditions of this agreement. We may notify you of any changes to your site that we consider necessary, or ensure that your links to our site are appropriate and notify you of any changes we consider necessary. If you do not make the changes to your site that we deem necessary, we reserve the right to terminate your participation in the Dr Mush Me Affiliate Program.
Dr Mush Me reserves the right to terminate this agreement and your participation in the Dr Mush Me Affiliate Program immediately and without notice if you commit fraud in your use of the Dr Mush Me Affiliate Program or abuse the program in any way. If such fraud or abuse is detected, Dr Mush Me will not be liable to you for commissions for such fraudulent sales.
This agreement is effective upon acceptance of your application for membership and will continue until terminated.
Termination
Either you or we may terminate this agreement at ANY time, with or without cause, by giving the other party written notice. Written notice may be in the form of a letter, email or fax. In addition, this agreement will terminate immediately if you breach this agreement.
Modification
We may change any of the terms and conditions of this agreement at any time and at our sole discretion. In the event of such an occurrence, you will be notified by e-mail. Changes may include, but are not limited to, changes in payment procedures and the rules of the Dr Mush Me affiliate program.
If a change is unacceptable to you, your only option is to terminate this agreement. Your continued participation in the Dr Mush Me Affiliate Program after the posting of the change notice or new agreement on our site will indicate your acceptance of the changes.
Affiliate commissions
- We will pay you the agreed commissions for each sale made on the drmushme.ie website using your affiliate link.
- The basis for calculating the agreed commission is the turnover of products sold on drmushme.ie using your affiliate link.
- The maximum discount you can give is 10%.
- Please contact Dr Mush Me to obtain the 10% discount code.
- Please bear in mind that your customer can only have one discount code at a time. If the customer, using an affiliate link, applies the discount code you have provided, this discount will reduce the number of agreed commissions.
- If your customer’s order is refunded, we will readjust the commissions payable in the following month.
Wholesale orders
- Our affiliate program does not cover wholesale purchases. We do not pay affiliate commissions on wholesale orders. As a wholesaler, you cannot receive commissions on your own orders through your own affiliate link or on wholesale orders placed by you or other wholesale accounts.
WE ARE NOT ABLE TO GO BACK AND READJUST COMMISSIONS, SO MAKE SURE YOUR REFERRALS USE YOUR CODE OR LINK WHEN THEY ORDER.
Commission payments
We pay commissions by the 25th of the following month for the previous month by bank transfer, but not before your commissions have reached at least 20 euros.
For example, commissions received from the 1st of April to the 31st of April are paid on the 25th of May.
Payment schedule
As long as your current affiliate earnings are over €20, you will be paid each month. If you haven’t earned €20 since your last payment, we’ll pay you the next month once you’ve passed the threshold.
Choice of law: jurisdiction and venue
These terms and conditions shall be interpreted in accordance with Irish law.
Assignment
You may not assign these terms and conditions or assign any rights or delegate any obligations hereunder, in whole or in part, without our prior written consent. Any purported assignment or delegation by you without the appropriate prior written consent will be null and void and of no effect. We may assign these terms and conditions or any rights hereunder without your consent and without notice to you.
